We respect your privacy. This Privacy Policy explains why we collect personal information, what we collect, how we use and store it, and your rights in relation to it.

By using our website, software, products, or services, or by entering into an agreement with us, you acknowledge that you have read and understood this Privacy Policy.

1. About Us and This Policy

1.1 Triniteq International Pty Ltd (ABN: 81 092 943 649) "Triniteq" respects your right to privacy and is committed to safeguarding the personal information of our Customers, website visitors, and end users. This policy sets out how we collect, use, store, and handle personal information.

1.2 We adhere to the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth), as amended by the Privacy and Other Legislation Amendment Act 2024 (Cth) (POLA Act), and to the extent applicable, the EU General Data Protection Regulation (GDPR).

1.3 This Privacy Policy must be read together with Triniteq Terms of Use (Schedules 1, 2, 3, 4, 5 & 6), which govern the broader relationship between Triniteq and its Customers. Where personal information is collected or processed in the course of a Customer relationship, the terms of the applicable Schedule and this Privacy Policy apply together.

1.4 Personal information is information we hold that is identifiable as being about you. This includes your name, email address, phone number, postal address, account credentials, and any other information that can reasonably identify an individual, either directly or indirectly.

1.5 For the purposes of this policy, we distinguish between three categories of individuals whose personal information we may handle:

(a) Customers and their authorised End Users, being businesses and individuals who enter into agreements with Triniteq and use our products and services;
(b) Website Visitors, being individuals who visit www.triniteq.com or interact with us without necessarily being a Customer; and
(c) Customers' customers, being individuals such as patrons, diners, members, or guests whose personal information is entered into our systems by a Customer or their staff in the course of operating their business.

2. What Personal Information We Collect

2.1 Triniteq collects personal information you provide to us directly, information submitted through our website, and information generated through your use of our products and services.

2.2 The personal information we collect may include:

  • names, phone numbers, postal addresses, and email addresses;
  • business names, ABNs, and contact details;
  • account login credentials, including usernames and passwords;
  • billing and payment information (processed by our third-party payment providers, see clause 7);
  • technical data relating to your use of our software and services, including device identifiers, IP addresses, browser type, and operating system information;
  • Customer data entered into our software products, such as menu and product data, transaction data, and business configuration data;
  • personal information about a Customer's customers (such as patrons, diners, members, or guests), including names, phone numbers, postal addresses, and email addresses, entered into our systems by a Customer or their staff (see section 6 for further detail); and
  • any other information you provide when communicating with us or using our services.

2.3 We may also collect additional information when you respond to surveys or promotions, request support, provide feedback, or communicate with our Customer support team.

2.4 We do not collect or store credit card or financial account numbers. Payment information for Triniteq's own Customers is handled directly by our third-party payment providers in accordance with their respective privacy policies. We also do not store or use the credit card or payment information of a Customer's customers. Any payment transactions processed on behalf of a Customer's customers are handled directly by that Customer's own payment provider, financial institution, or EFTPOS provider, and are not stored in Triniteq's systems.

2.5 Personal information relating to End Users (individuals authorised by a Customer to use our services) may be provided to us by the Customer. The Customer is responsible for ensuring it has the authority or consent to provide such information to us for the purpose of Triniteq supplying its products and services, as required under Schedule 1 (clause 24) of the Terms of Use.

2.6 In the course of using Triniteq's software products (including PowerEPOS or WaiterPOS and related services), Customers and their End Users may enter personal information about the Customer's own customers directly into our systems. This may occur, for example, when managing loyalty programmes, reservations, ordering, or customer accounts. Triniteq stores this information solely for the purpose of providing the agreed services to the Customer and does not use, share, or commercialise it for any other purpose.

 

3. How We Collect Personal Information

3.1 Triniteq collects personal information in a variety of ways, including:

  • when you interact with us electronically, in person, or by telephone;
  • when you visit or submit information through our website;
  • when you place an order, accept a quote, or sign a service or maintenance agreement;
  • when you create an account or register to use our software;
  • when you engage with us during the provision of support, installation, training, or maintenance services;
  • when we receive information from third parties, such as credit reporting agencies (as permitted under the Privacy Act 1988 (Cth)); and
  • when a Customer or their End Users enter personal information about the Customer's own customers into our software systems in the course of operating their business.

3.2 By providing us with personal information, you consent to the collection and use of that information in accordance with this Privacy Policy.

3.3 Where we collect personal information from third parties, we will protect it in accordance with this Privacy Policy.

 

4. How We Use Personal Information

4.1 Triniteq uses personal information collected from you only for the purposes for which it was provided or as otherwise permitted by law. This may include to:

  • provide, administer, and manage our products and services;
  • process orders, quotes, and purchase orders;
  • communicate with you by telephone, email, SMS, or mail in relation to our services;
  • provide technical support and resolve issues with our software and hardware;
  • manage your account, including billing, payment, and subscription administration;
  • conduct credit assessments in accordance with clause 9 below;
  • research and develop our products, services, and systems;
  • provide you with information about new or additional products and services (where you have consented or where otherwise permitted);
  • comply with our legal and regulatory obligations; and
  • investigate complaints or disputes.

4.2 We may also use de-identified and aggregated data (which cannot reasonably identify any individual) for product improvement, statistical analysis, and reporting purposes. This is consistent with our obligations under Schedule 5 (clause 8.4) of the Terms of Use.

4.3 If you withhold personal information that is required for us to provide our services, we may not be able to supply those services or provide you with full access to our systems.

4.4 We may disclose your personal information where required to comply with a legal obligation, including a court order, subpoena, warrant, or request from a law enforcement agency.

4.5 If there is a change of control, sale, or transfer of Triniteq business or assets, we reserve the right to transfer personal information to a successor entity to the extent permitted by law.

 

5. Storage of Personal Information in Our Systems

5.1 Triniteq stores certain personal information (including Customer names and contact details) within our internal business systems. This information is used solely for the purposes described in this Privacy Policy, including account management, service delivery, support, and communication.

5.2 We do not store credit card numbers, bank account numbers, or other sensitive financial data in our systems. All payment data is handled exclusively by our authorised third-party payment providers.

5.3 Personal information stored in our systems is retained only for as long as is necessary to fulfil the purposes for which it was collected, or as required by law. We take reasonable steps to destroy or de-identify personal information once it is no longer required.

5.4 We implement appropriate technical and organisational measures to protect personal information stored in our systems from unauthorised access, modification, disclosure, misuse, loss, or destruction, consistent with our obligations under APP 11 and the POLA Act 2024.

5.5 Where our software products collect or store data entered by a Customer or End User, that data remains the property of the Customer at all times. Triniteq accesses Customer Data only to the extent necessary to provide the agreed services.

 

6. Our Customers' Customers

6.1 Triniteq's software products, including PowerEPOS or WaiterPOS and related services, are used by our Customers to operate their hospitality and retail businesses. In the course of providing these services, our systems may store personal information about our Customers' own customers (for example, patrons, diners, or members) that is entered into or processed through our software by the Customer or their staff.

6.2 The types of personal information about a Customer's customers that may be stored in our systems include names, phone numbers, postal addresses, and email addresses. More specifically, this information may include:

  • names, phone numbers, postal addresses, and email addresses, where provided for purposes such as loyalty programmes, reservations, customer accounts, or order management;
  • transaction and purchase history, where recorded by the Customer through the point-of-sale system; and
  • any other information entered into our systems by the Customer in connection with managing their business operations.

6.3 This information is entered into our systems by the Customer and remains the property of the Customer at all times. Triniteq acts as a data processor in respect of this information and accesses it only to the extent necessary to provide the agreed services to the Customer.

6.4 The Customer is solely responsible for ensuring that its collection, use, and storage of personal information about their own customers through our systems complies with all applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and any other applicable legislation. This includes obtaining any necessary consents from individuals whose personal information is entered into our systems.

6.5 Triniteq does not use, share, or disclose personal information about a Customer's customers for any purpose other than providing the services to that Customer, unless required to do so by law. We do not sell, rent, or otherwise commercialise this information.

6.6 Triniteq has no access to, and does not retain, any payment data.

6.7 Triniteq implements appropriate technical and organisational security measures to protect this information. In the event of a data breach involving a Customer's customers' personal information, Triniteq will notify the affected Customer as soon as practicable and will cooperate with the Customer in meeting any applicable notifiable data breach obligations.

 

7. Disclosure of Personal Information

7.1 Triniteq may disclose your personal information to:

  • our employees, officers, insurers, professional advisers, agents, and contractors, to the extent reasonably necessary to deliver our services;
  • third-party service providers who assist us in operating our business, subject to appropriate privacy and confidentiality obligations;
  • payment processors, for the purpose of processing payments; and
  • credit reporting agencies and trade referees as permitted under the Privacy Act 1988 (Cth) (see clause 9).

7.2 The following third parties may store or process personal information in connection with our services:

(a) HubSpot: when you subscribe to our newsletter or mailing list, we use HubSpot to store your name and email address for communication purposes. HubSpot is certified under applicable data protection frameworks. You may unsubscribe at any time by using the unsubscribe link in any email communication.
(b) By submitting payment details to our payment providers, you agree to their respective privacy policies and end user licence agreements. Triniteq does not receive or store your full card or account details.

7.3 We require all third-party service providers who handle personal information on our behalf to comply with applicable privacy laws and to maintain appropriate security measures.

7.4 We will not sell, rent, or trade your personal information to third parties for marketing purposes.

 

8. General Data Protection Regulation (GDPR) for the European Union

8.1 To the extent that we collect or process the personal data of individuals residing in the European Union (EU) or European Economic Area (EEA), Triniteq complies with the principles of data protection set out in the GDPR.

8.2 We process personal data as a Controller, or as a Processor where we act on behalf of a Customer who is the Controller, as those terms are defined in the GDPR.

8.3 Our lawful bases for processing personal data under the GDPR include:

(a) consent: where you have given us clear, express consent to process your data for a specific purpose;
(b) contract performance: where processing is necessary to fulfil a contract with you, or to take steps at your request before entering into a contract;
(c) legal obligation: where processing is necessary to comply with a legal requirement; and
(d) legitimate interests: where processing is necessary for our legitimate business interests, provided those interests are not overridden by your rights.

8.4 We collect only the personal data that is necessary for the purposes described in this policy. We do not collect or process special categories of personal data (Sensitive Personal Information under the GDPR) unless we have obtained your explicit consent or are otherwise permitted to do so by law.

8.5 Individuals under the age of 16 must not provide us with personal information without the consent of a parent or person with parental authority. We do not knowingly collect personal information from children.

8.6 If you are an individual residing in the EU or EEA, you have the following rights under the GDPR:

(a) to be informed about how your personal data is used;
(b) to access your personal data (we will provide a free copy on request);
(c) to have inaccurate or incomplete data corrected;
(d) to request deletion of your personal data (the right to be forgotten);
(e) to restrict the processing of your personal data;
(f) to data portability, to receive your data in a structured, commonly used format;
(g) to object to processing of your personal data; and
(h) to object to automated decision-making and profiling.

9. Credit Information (Privacy Act 1988 (Cth))

9.1 Consistent with Schedules 1 and 2 of the Terms of Use, the Customer and/or any Guarantor agrees that Triniteq may:

(a) obtain a consumer or commercial credit report from a credit reporting agency in relation to credit provided by Triniteq;
(b) exchange credit information with nominated trade referees or credit providers for the purposes of assessing creditworthiness, notifying defaults, or exchanging account status information; and
(c) provide information to a credit reporting agency for the purpose of maintaining a credit information file.

9.2 Personal credit information may be used by Triniteq for the purposes of service provision, credit assessment, payment processing, and account management.

 

10. Hosting and International Data Transfers

10.1 Personal information that we collect may, from time to time, be stored, processed, or transferred between parties or systems located in countries outside Australia.

10.2 The hosting facilities for our website and primary systems are situated in Australia.

10.3 Where personal information is transferred internationally, we take reasonable steps to ensure it receives a standard of protection consistent with Australian privacy law and, where applicable, the GDPR. Safeguards may include the use of standard contractual clauses approved by the European Commission, binding corporate rules, or other appropriate mechanisms.

10.4 You may obtain further information about our international transfer safeguards by contacting our Data Protection Officer at the details set out in clause 14.

10.5 You acknowledge that personal information submitted for publication through our website or services may be available, via the internet, globally. We cannot prevent the use or misuse of such information by others.

 

11. Security of Personal Information

11.1 Triniteq is committed to keeping your personal information secure. We have implemented physical, electronic, and organisational measures to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure, consistent with our obligations under APP 11 as updated by the POLA Act 2024.

11.2 Where we engage data processors to process personal information on our behalf, we require those processors to comply with applicable privacy laws and to maintain adequate technical and organisational security measures.

11.3 In the event of a data breach that is likely to result in serious harm to affected individuals, we will comply with the Notifiable Data Breach (NDB) scheme under the Privacy Act 1988 (Cth), including notifying the Office of the Australian Information Commissioner (OAIC) and affected individuals as required by law.

11.4 The transmission of information over the internet carries inherent risks. Whilst we take steps to safeguard your information, we cannot guarantee the security of information transmitted to or from us.

 

12. Access to and Correction of Your Personal Information

12.1 You may request access to the personal information we hold about you in accordance with the Privacy Act 1988 (Cth) and, where applicable, the GDPR. You may also request correction of information that is inaccurate, out of date, incomplete, irrelevant, or misleading. To make such a request, please contact us at privacy@triniteq.com.

12.2 We will respond to access and correction requests within a reasonable time. We may ask you to verify your identity before providing access.

12.3 We reserve the right to decline an access request in circumstances set out in the Privacy Act 1988 (Cth) or any other applicable law. Where we refuse a request, we will provide written reasons.

 

13. Complaints

13.1 If you have a complaint about our privacy practices, please send the details of your complaint in writing to privacy@triniteq.com. We take all privacy complaints seriously and will respond within a reasonable time of receiving your written complaint.

13.2 If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au, or if you are located in the EU or EEA, your relevant supervisory authority.
